Medium-Term Rental Agreement

This Medium-Term Rental Agreement ("Agreement") governs the occupation of Eden Haus properties for stays of 30 days or longer. It is entered into between the Guest named in the Reservation Confirmation and Eden Haus Management (Pty) Ltd ("Eden Haus", "Host"). By confirming a reservation, the Guest agrees to be bound by the terms of this Agreement in full.
This Agreement is entered into on a short-term, self-catering accommodation basis and does not constitute a residential lease. It should be read in conjunction with our Terms & Conditions. For any queries, contact us at [email protected] or +27 64 515-6915.
The Parties
This Agreement is made between:
- Main Guest — the person named in the Reservation Confirmation ("Guest"), and
- Host — Eden Haus Management (Pty) Ltd ("Eden Haus" or "Host").
The Guest accepts these terms on behalf of all occupants and visitors to the Premises during the Lease Term. The Guest remains fully responsible for the conduct of all persons on the Premises.
The Premises
The Host agrees to make available the property described in the Reservation Confirmation to the Guest for the duration of the Lease Term. The Premises address and specific details are set out in the Reservation Confirmation issued by Eden Haus upon receipt of the required deposit.
The Guest is not permitted to sublet the Premises or any part thereof, nor to allow any person other than those listed in the Reservation Confirmation to occupy the Premises overnight without prior written consent from Eden Haus.
Lease Term
The Lease Term commences on the Check-In Date and ends on the Check-Out Date as specified in the Reservation Confirmation. The minimum stay for this Agreement is 30 consecutive nights.
Check-in is from 15:00 on the Check-In Date. Check-out is by 10:00 on the Check-Out Date. Late check-out may be arranged subject to availability and at the Host's sole discretion.
Rental Amount & Payment Terms
The monthly rental amount is set out in the Reservation Confirmation. Payment is due in full, in advance, on or before the first day of each rental month. Eden Haus reserves the right to apply a late payment fee of 5% of the monthly rental for any payment received after the due date.
All payments must be made by electronic funds transfer (EFT) or via the booking platform used to confirm the reservation. Cash payments are not accepted.
Security Deposit
A refundable security deposit equivalent to one month's rental is payable prior to check-in. The deposit will be held by Eden Haus and applied against any damage, outstanding charges, or unpaid amounts at the end of the Lease Term.
The deposit will be refunded within 14 business days of the Check-Out Date, subject to a satisfactory inspection of the Premises and settlement of all outstanding charges. Eden Haus will provide a written itemisation of any deductions made.
Extension of Stay
Any request to extend the Lease Term beyond the original Check-Out Date must be submitted in writing to Eden Haus at least 14 days before the original Check-Out Date. Extensions are subject to availability and confirmation by Eden Haus in writing.
An extension of stay does not create a new or separate tenancy. The Guest's continued occupation remains governed by this Agreement and all its terms, including the self-catering, non-residential nature of the arrangement.
Unpaid Extensions & Holdover — Eviction Protocol
If the Guest remains in occupation of the Premises beyond the Check-Out Date without a confirmed written extension from Eden Haus, the Guest shall be regarded as a holdover occupant. In such circumstances:
- Eden Haus will issue a written notice to vacate within 24 hours of the original Check-Out Date.
- If the Guest fails to vacate within the notice period, Eden Haus reserves the right to take all lawful steps to recover possession of the Premises, including applying to the relevant court for an urgent eviction order.
- The Guest acknowledges that, as this Agreement does not constitute a residential lease, the protections afforded to residential tenants under the Rental Housing Act do not apply. However, Eden Haus will act in accordance with applicable South African law, including the Prevention of Illegal Eviction from and Unlawful Occupation of Land Act (PIE Act), where applicable.
- The Guest will be liable for a holdover fee equal to 150% of the daily rental rate for each day of unauthorised occupation, in addition to any legal costs incurred by Eden Haus in recovering possession.
If the Guest fails to pay the rental for any month by the due date and does not remedy the default within 48 hours of written notice from Eden Haus, Eden Haus may terminate this Agreement immediately and require the Guest to vacate the Premises forthwith. The same eviction process as described above will apply.
Notice Period for Early Termination
Either party may terminate this Agreement before the end of the Lease Term by giving 30 days' written notice to the other party. Notice must be delivered by email to the addresses set out in the Reservation Confirmation.
If the Guest terminates early without providing the required notice, the Guest shall forfeit the security deposit and remain liable for the rental for the notice period.
Utilities & Services
Unless otherwise stated in the Reservation Confirmation, the following are included in the monthly rental:
- Electricity (subject to a fair usage policy)
- Water
- High-speed WiFi
- Weekly housekeeping service
- Linen and towel changes (weekly)
Excessive utility usage beyond a reasonable residential threshold may be charged to the Guest at cost. Eden Haus will notify the Guest in writing before applying any such charge.
Maintenance & Defects
The Guest must notify Eden Haus of any defects, damage, or maintenance issues within 12 hours of check-in or within 12 hours of the defect becoming apparent during the stay. Failure to report a defect timeously may result in the Guest being held liable for the cost of repair.
Eden Haus will attend to reported maintenance issues within a reasonable time. The Guest must not attempt to carry out repairs or alterations to the Premises without prior written consent from Eden Haus.
Guest Conduct
The Guest agrees to:
- Keep the Premises clean and in good order throughout the stay.
- Not cause nuisance or disturbance to neighbours or other residents of the building.
- Comply with all body corporate or homeowners' association rules applicable to the Premises.
- Not smoke inside the Premises. Smoking is permitted only in designated outdoor areas.
- Not keep pets on the Premises without prior written consent from Eden Haus.
- Not host events, parties, or gatherings without prior written consent from Eden Haus.
Damage & Liability
The Guest is responsible for any damage caused to the Premises, its fixtures, fittings, furniture, or appliances during the Lease Term, whether caused by the Guest, other occupants, or visitors. Eden Haus reserves the right to deduct the cost of any damage from the security deposit and to claim any shortfall from the Guest.
Eden Haus shall not be liable for any loss, theft, or damage to the Guest's personal property on the Premises. The Guest is advised to arrange appropriate personal insurance for the duration of the stay.
Access to Premises
Eden Haus or its authorised representatives may access the Premises for the purposes of inspection, maintenance, or repair, provided that 24 hours' written notice is given to the Guest, except in the case of emergency where immediate access may be required.
Cancellation Policy
If the Guest cancels a confirmed reservation before the Check-In Date:
- More than 30 days before check-in: Full refund of the deposit, less any non-refundable booking fees.
- 15–30 days before check-in: 50% of the first month's rental is forfeited.
- Less than 14 days before check-in: The full first month's rental is forfeited.
Cancellation terms apply to standard rates only. Promotional or discounted rates may be subject to stricter cancellation conditions as specified at the time of booking.
Illegal Activity
The Guest shall not use the Premises for any illegal purpose or activity. Any illegal activity on the Premises will result in the immediate termination of this Agreement and the Guest will be required to vacate forthwith. Eden Haus reserves the right to report any illegal activity to the relevant authorities.
Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from this Agreement shall be resolved in the courts of South Africa having jurisdiction over the Premises.
Regulatory Disclaimer
Eden Haus Management (Pty) Ltd is not registered with the Property Practitioners Regulatory Authority (PPRA). All agreements concluded by Eden Haus are entered into in accordance with short-term rental and self-catering accommodation conditions. These agreements do not constitute a residential lease and are not subject to the Rental Housing Act or the provisions of the PPRA Act.
Guests occupy the Premises on a short-term, self-catering basis only. No right of occupation, tenancy, or residential lease is created by this Agreement, regardless of the duration of the stay.
Entire Agreement
This Agreement, together with the Reservation Confirmation and the Eden Haus Terms & Conditions, constitutes the entire agreement between the parties with respect to the subject matter hereof. No variation, amendment, or waiver of any term shall be effective unless agreed in writing by both parties.
