Short-Term Rental Agreement

This Short-Term Rental Agreement ("Agreement") governs the occupation of Eden Haus properties. It is entered into between the Guest named in the Reservation Confirmation and Eden Haus Management (Pty) Ltd ("Eden Haus", "Host"). By confirming a reservation, the Guest agrees to be bound by the terms of this Agreement in full.

The Parties

This Agreement is made between:

  • Main Guest — the person named in the Reservation Confirmation ("Guest"), and
  • Host — Eden Haus Management (Pty) Ltd ("Eden Haus" or "Host").

The Guest accepts these terms on behalf of all occupants and visitors to the Premises during the Lease Term. The Guest remains fully responsible for the conduct of all persons on the Premises.

The Premises

The Host agrees to lease the property described in the Reservation Confirmation to the Guest for the duration of the Lease Term. The Premises address and specific details are set out in the Reservation Confirmation issued by Eden Haus upon receipt of the required deposit.

Lease Term

The Guest shall be permitted to occupy the Premises from the check-in date at 15:00 to the check-out date at 10:00 as specified in the Reservation Confirmation ("Lease Term").

  • Early check-in or late check-out may be arranged subject to availability and may incur an additional charge.
  • Failure to vacate by the agreed check-out time may result in an overstay fee of up to double the average nightly rate per additional day or part thereof.

Quiet Hours

Quiet hours are in effect from 22:00 each evening until 07:00 the following morning. During quiet hours, the Guest agrees to:

  • Keep all audio at a minimum level.
  • Refrain from playing music audible outside the Premises.
  • Ensure no visitors are present on the Premises.

These requirements exist out of respect for neighbouring residents and the surrounding community. Breach of quiet hours may result in fines, eviction, and forfeiture of the security deposit.

Occupants

The total number of occupants permitted on the Premises at any time shall not exceed the number stated in the Reservation Confirmation, including infants and children.

  • All guests who will be sleeping at the property must be registered with Eden Haus no later than 24 hours after check-in. Unregistered guests are not permitted.
  • If more than the authorised number of guests, or any unregistered guests, are found on the Premises, this Agreement may be terminated immediately by the Host without refund.
  • No more than 2 visitors per bedroom are permitted on the Premises at any one time (e.g. a studio permits 1 visitor).

Booking Fees

The Guest shall pay the Host the amount as detailed during the booking process and confirmed in the Reservation Confirmation. A once-off booking administration fee of up to R595 per reservation applies. All amounts are payable in accordance with the payment schedule set out in the Reservation Confirmation.

Utilities

The Host shall be responsible for all standard utilities and services to the Premises, including electricity, water, and Wi-Fi, unless otherwise specified in the Reservation Confirmation. Any additional services requested by the Guest that are not included in the standard offering will be charged to the Guest.

Security Deposit

Within 7 days of the check-in date, the Guest is required to complete identity verification and provide a security deposit through Eden Haus's trusted verification partner, Truvi (previously Superhog) — a globally recognised trust and safety company.

  • Upon booking, the Guest will be contacted directly by Truvi to complete identity verification and to arrange either a fully refundable deposit (plus a non-refundable administration fee) or a non-refundable damage waiver.
  • Both options cover accidental damage caused during the stay. The deposit or waiver shall not be credited towards any rental amount unless Eden Haus provides written consent.
  • The Guest is required to complete the Truvi verification process prior to check-in.
  • If the Guest does not wish to complete this verification process, they are welcome to cancel their reservation within 12 hours of making the booking.

Pets

Pets are not permitted on the Premises. If the Guest is found to have brought pets onto the Premises without prior written consent from Eden Haus, this Agreement and any security deposit shall be forfeited and the Guest may be required to vacate immediately.

Smoking Policy

Smoking is strictly prohibited on the Premises. This includes cigarettes, pipes, cigars, hookah pipes, marijuana, and e-cigarettes, whether inside or outside the property unless a designated outdoor smoking area is specified.

  • Any guest found smoking inside the property will be levied a fine of R2,000 per incident, payable immediately by card or cash to the Host.
  • A second breach will result in immediate eviction without refund.
  • Additional charges may be levied for professional upholstery, linen, curtain cleaning, and sanitising where required.

Subletting & Visitors

  • The Guest does not have the right to sublet the Premises or any part thereof.
  • No more than 2 visitors per bedroom are permitted at any one time (e.g. a studio or 0.5 bedroom permits 1 visitor).
  • The Premises may not be used for any purpose other than standard residential accommodation. Any alternative usage — including as an event venue, catering space, or film location — must be agreed in writing with Eden Haus prior to occupation and may be subject to additional charges.

Inspection

Eden Haus reserves the right to inspect the Premises with reasonable prior notice. It is the Guest's responsibility to notify Eden Haus in writing within 12 hours of check-in of any defects or missing inventory items. Failure to do so will be deemed acknowledgement that the Premises was received in good order and condition. Eden Haus undertakes to remedy any reported defects as soon as reasonably possible.

Maintenance & Repairs

  • No sleeping on the couch and no shoes on the furniture.
  • The Guest shall maintain the Premises in a good, clean, and ready-to-rent condition and use the Premises only in a careful and lawful manner.
  • The Guest shall leave the Premises in a condition immediately habitable by the next guest at the expiration of this Agreement.
  • The Guest shall pay for maintenance and repairs where the Premises are left in a lesser condition. Eden Haus reserves the right to deduct the costs of such services from the security deposit prior to any refund.

Waste & Refuse

The Guest shall dispose of all waste material generated during the Lease Term in accordance with the instructions provided by Eden Haus at check-in and as set out in the property's house guide. Refuse must not be left outside the designated collection areas.

Quiet Enjoyment

The Guest, together with neighbours, shall enjoy each other's company in a quiet and respectful manner. The Guest is expected to behave in a considerate manner and to be a good neighbour to all residents of the immediate area. Large gatherings, parties, or any disturbance to the surrounding community shall constitute grounds for immediate termination of this Agreement without refund.

Host's Liability

The Guest and all visitors to the Premises hereby indemnify and hold harmless Eden Haus against any and all claims of personal injury, property damage, or loss arising from the use of the Premises, regardless of the nature of the negligence, accident, injury, or loss. The Guest acknowledges that any insurance maintained by Eden Haus on the property does not cover the personal property of the Guest, and that the Guest should arrange their own insurance if such coverage is required.

Attorney's Fees

The Guest agrees to pay all reasonable costs, attorney's fees, and expenses incurred by Eden Haus in enforcing this Agreement.

Use of Premises

The Guest shall use the Premises for residential purposes only. The Guest is not authorised to sell products or services on the Premises or to conduct any commercial activity of any nature.

Illegal Activity

The Guest shall use the Premises for lawful purposes only. Any use that includes but is not limited to illicit drug use, verbal or physical abuse of any person, or illegal sexual behaviour shall result in the immediate termination of this Agreement without refund of any pre-paid rental.

Possessions

Any personal items or possessions left on the Premises after departure are not the responsibility of Eden Haus. Eden Haus shall make every reasonable effort to return such items to the Guest. If no claim is made within two (2) weeks of departure, Eden Haus reserves the right to donate or dispose of such items.

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the Republic of South Africa. Should the Guest violate any of the terms of this Agreement, the rental period shall be terminated immediately. The Guest waives all rights to process if they fail to vacate the Premises upon termination of the rental period. The Guest shall vacate the Premises at the expiration time and date of this Agreement.

Property Rules

The Guest agrees to comply with the rules of the Body Corporate or homeowners' association applicable to the Premises, as well as any property-specific house rules provided by Eden Haus at check-in. These rules form part of this Agreement and any breach thereof shall constitute a breach of this Agreement.

Regulatory Disclaimer

Eden Haus Management (Pty) Ltd is not registered with the Property Practitioners Regulatory Authority (PPRA). All agreements concluded by Eden Haus are entered into in accordance with short-term rental and self-catering accommodation conditions. These agreements do not constitute a residential lease and are not subject to the Rental Housing Act or the provisions of the PPRA Act.

Guests occupy the Premises on a short-term, self-catering basis only. No right of occupation, tenancy, or residential lease is created by this Agreement.
