Terms & Conditions

The following sets out the terms and conditions that govern all reservations made with Eden Haus Management (Pty) Ltd ("Eden Haus", "we", "us", "the Manager"). By confirming a reservation — whether directly, via a third-party platform, or through a travel agent — the Guest acknowledges that they have read, understood, and agreed to be bound by these Terms and Conditions in their entirety.

1. Interpretation

In these Terms and Conditions, unless the context indicates otherwise:

  • "Manager" means Eden Haus Management (Pty) Ltd, acting as the duly authorised agent of the Owner.
  • "Guest" means the person(s) named in the Reservation Confirmation, together with their invitees and occupants, who are entitled to occupy the Premises during the Occupation Period.
  • "Owner" means the registered owner of the Premises, whose details are available on request.
  • "Premises" means the property to be occupied as set out in the Reservation Confirmation.
  • "Occupation Period" means the period commencing on the Occupation Date and terminating on the Termination Date.
  • "Deposit" means the initial payment required to confirm a reservation, as set out in the Reservation Confirmation.
  • "Security Deposit" means the refundable breakage and damage deposit collected prior to or upon arrival.
  • "Reservation Confirmation" means the written confirmation issued by Eden Haus upon receipt of the required deposit.
  • "Force Majeure" means any event beyond the reasonable control of either party, including but not limited to fire, flood, acts of God, civil unrest, or government-imposed restrictions.

References to the singular include the plural and vice versa. This Agreement is governed by the laws of the Republic of South Africa.

2. The Eden Haus Guest Guarantee

Eden Haus guarantees that every property in our portfolio is clean, well-maintained, accurately described, and ready for occupation upon your arrival. If, upon check-in, you believe your property does not meet these standards, please notify us immediately and we will work to resolve the matter or, where necessary, arrange suitable alternative accommodation.

Please note the following conditions apply to any guarantee claim:

  • Issues must be reported within twelve (12) hours of arrival and must be supported by photographs and a written description.
  • No post-departure compensation or refund requests will be considered.
  • Where applicable, refunds will be net of any third-party platform commissions already disbursed.
  • Should the Guest choose to vacate the property voluntarily on the basis of a personal preference (rather than a genuine deficiency), the standard cancellation policy will apply.
  • In the event of a dispute, Eden Haus is committed to fair and transparent resolution. Where agreement cannot be reached, mediation may be sought through a mutually agreed-upon third party.

3. Reservation & Payment Terms

A reservation is only confirmed once Eden Haus has received the required deposit in cleared funds and has issued a written Reservation Confirmation. Eden Haus reserves the right to decline any booking at its sole discretion.

  • A once-off booking administration fee of up to R595 per reservation applies.
  • Should the balance not be received by the due date, Eden Haus reserves the right to cancel the reservation and apply the cancellation policy below.
  • All payments are to be made via electronic transfer to the nominated account, or as otherwise agreed in writing by Eden Haus.
  • Prior to arrival, Eden Haus requires all guests to complete a verification process and provide a valid credit card for the security deposit. Details of this process will be communicated at the time of booking.

4. Cancellation Policy

These cancellation terms apply to standard rates only. Promotional, non-refundable, or platform-specific rates are governed by the terms stated at the time of booking. Cancellations must be submitted in writing to [email protected].

  • Refunds and waivers of cancellation policies are at the sole discretion of Eden Haus management, subject to the ability to re-let the property.
  • In the event that the cancelled dates are successfully re-let, Eden Haus may charge an administration fee of 20% and refund the balance at management's discretion.
  • No cancellation fee will be charged in the event of the death or hospitalisation of the primary Guest, subject to provision of supporting documentation.
  • Should a Force Majeure event render the Premises uninhabitable, Eden Haus will reimburse the Guest on a pro rata basis for the affected period.
  • Eden Haus strongly advises all guests to obtain travel and cancellation insurance.

5. Security & Breakage Deposit

Prior to or upon arrival, the Guest agrees to provide a refundable security and breakage deposit of up to R50,000 (fifty thousand rand), or as otherwise specified in the Reservation Confirmation. This deposit is held to cover any damages, breakages, additional cleaning costs, or other charges arising from the Guest's occupation.

  • The deposit will be collected by credit card pre-authorisation or electronic transfer as directed by Eden Haus.
  • Deductions from the deposit will be based on actual costs, supported by invoices or quotes, and a reasonable administration fee may apply.
  • The Guest authorises Eden Haus to debit any amount owing from the deposit upon expiry or earlier termination of the reservation.
  • Any remaining deposit balance will be refunded within 21 (twenty-one) days of departure, subject to a satisfactory inspection of the Premises.
  • The Guest may not offset any amounts owing under this Agreement against the security deposit.

6. Arrival & Departure

  • Standard check-in time is 15:00 on the day of arrival.
  • Standard check-out time is 10:00 on the day of departure.
  • Early check-in or late check-out may be accommodated subject to availability and may incur an additional charge of up to half a day's rental. Requests must be made in advance via [email protected] or +27 64 515-6915.
  • Upon check-in, the Guest will be required to present valid photographic identification and proof of the credit card used for the security deposit.
  • Should the Guest fail to vacate the Premises by the agreed check-out time, Eden Haus reserves the right to charge an overstay fee at a rate of up to double the average nightly rate for each additional day or part thereof, plus all applicable fees, taxes, and any legal costs incurred.
  • By agreeing to these Terms and Conditions, the Guest authorises Eden Haus to utilise the security deposit to cover any breakages or damages to the property.

7. Guest Conduct & House Rules

All Eden Haus properties are situated within residential communities. Guests agree to conduct themselves in a manner that is respectful of neighbours, the property, and the surrounding environment at all times.

Smoking

All Eden Haus properties are strictly non-smoking. This includes cigarettes, pipes, cigars, hubbly bubbly, and marijuana, whether inside or outside the property unless a designated outdoor smoking area is specified. Any breach will result in a fine of R5,000 per incident, payable immediately by card or cash, and may result in immediate eviction without refund. Additional charges may be levied for professional upholstery, linen, curtain cleaning, and sanitising.

Noise & Disturbance

Excessive noise, parties, or conduct causing nuisance to neighbours or contravening body corporate by-laws is strictly prohibited. A breach may result in fines of up to R10,000, immediate eviction, and forfeiture of all payments made.

Visitors

Only registered guests whose identification has been provided to Eden Haus are permitted on the Premises. Additional occupants must be approved in writing by Eden Haus prior to arrival and may incur additional charges. The Guest remains fully responsible for the conduct of all visitors and occupants.

Pets

Pets are not permitted on the Premises unless expressly agreed in writing by Eden Haus prior to arrival.

General Obligations

  • The Guest shall not sub-let the Premises or any part thereof without the prior written consent of Eden Haus.
  • The Guest shall not make any alterations or additions to the Premises.
  • The Guest shall not duplicate any keys or access codes and shall return all keys and access devices upon departure.
  • The Guest shall notify Eden Haus in writing within 12 hours of check-in of any defects or missing inventory items. Failure to do so will be deemed acknowledgement that the Premises was received in good order and condition.
  • The Guest shall keep the Premises clean and tidy and shall ensure that refuse is disposed of appropriately.
  • The Guest shall comply with all applicable body corporate rules, local by-laws, and any property-specific house rules provided at check-in.

8. Events Policy

Eden Haus properties are made available for residential accommodation purposes only. They are not intended or licensed for use as event venues, film locations, commercial shoots, or any other non-residential purpose.

Any request to use a property for an event or non-residential purpose must be submitted in writing to Eden Haus prior to the Occupation Date. Such requests will be considered at management's sole discretion and, if approved, will be subject to a separate written agreement and additional fees.

Unauthorised events or gatherings exceeding the registered number of occupants may result in immediate eviction without refund and the forfeiture of the security deposit.

9. Liability

The Guest accepts full liability for all minors and visitors to the Premises during the Occupation Period. Eden Haus, its employees, agents, and representatives shall not be liable for any loss, injury, damage, or inconvenience suffered by the Guest or any visitor arising from or in connection with the occupation of the Premises, except where such loss or damage is directly attributable to the gross negligence or wilful misconduct of Eden Haus.

Eden Haus shall not be liable for any loss or damage to the Guest's personal property left on the Premises. Guests are advised to ensure adequate travel and personal property insurance is in place for the duration of their stay.

Eden Haus shall not be liable for any interruption to services such as electricity, water, internet, or other utilities that are beyond its reasonable control.

10. Breach

If either party commits a breach of any term of this Agreement, the aggrieved party shall be entitled to give the defaulting party one (1) hour's written notice to remedy such breach. If the breach is not remedied within that period, the aggrieved party shall be entitled, without prejudice to any other rights, to cancel the Agreement and/or claim damages.

Should Eden Haus institute legal proceedings as a result of a breach by the Guest, the Guest shall be liable for all legal costs incurred by Eden Haus, including costs on the attorney-and-own-client scale, tracing fees, and collection commission.

11. General

  • No variation, amendment, or cancellation of these Terms and Conditions shall be of any force or effect unless reduced to writing and signed by both parties.
  • These Terms and Conditions constitute the entire agreement between Eden Haus and the Guest and supersede all prior negotiations, representations, and agreements.
  • No indulgence or extension of time granted by Eden Haus shall be construed as a waiver of any of its rights.
  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
  • The Guest consents to the jurisdiction of the Magistrate's Court for any dispute arising from this Agreement, notwithstanding that the amount in dispute may exceed the jurisdiction of such court.
